Terms and Conditions Kite Maroc – Surf, Kite & Wingfoil School Essaouira, Morocco

By booking any lesson, course, rental, package, or service with Kite Maroc (hereinafter “we”, “us”, “our”, or “Kite Maroc”), you (the “Participant” or “you”) agree to these Terms and Conditions. These terms form the basis of the contract between you and Kite Maroc. Please read them carefully before booking.
1. Services
Kite Maroc provides kitesurfing, surfing, wingfoiling lessons, courses, equipment rentals, and related water sports activities in Essaouira, Morocco. All activities are conducted by qualified, IKO-certified instructors where applicable. Lessons and rentals are subject to availability, weather conditions, and safety requirements.
2. Booking and Reservations
- Reservations are required in advance for all lessons, courses, and rentals.
- A booking is confirmed only upon receipt of the required deposit and issuance of a confirmation email or written confirmation from Kite Maroc.
- All bookings are personal and non-transferable.
3. Payments and Deposits
- A non-refundable deposit (typically 30–50% of the total price, as specified at the time of booking) is required to secure your reservation.
- The remaining balance is due in full before the start of the activity (usually 48 hours prior or on the day, depending on the package).
- Payments can be made by cash (MAD or EUR), bank transfer, or other methods accepted by Kite Maroc. All prices are in Moroccan Dirhams (MAD) or Euros (€) and are subject to change without prior notice.
- Deposits are strictly non-refundable under any circumstances (including weather, illness, or change of plans). This policy aligns with standard practice among Essaouira water sports schools.
4. Cancellations and Refunds
We base our cancellation policy on common practices of leading Essaouira competitors (such as Airekite, Kitesurf School Essaouira, and similar local schools) while maintaining a fair yet business-protective approach.
Client Cancellations:
- Cancellations must be made in writing (email or WhatsApp) and acknowledged by Kite Maroc.
- More than 48 hours before the scheduled activity: You may reschedule (subject to availability) or receive a refund of the balance paid (excluding the non-refundable deposit).
- Between 24 and 48 hours before the activity: 50% of the balance may be refunded or applied as credit for a future rescheduled date (at our discretion).
- Less than 24 hours before the activity, no-show, or late arrival: No refund or credit. The full amount is forfeited.
- No-shows or failure to attend without notice result in 100% forfeiture.
School Cancellations or Modifications (including Weather):
- Kite Maroc reserves the right to cancel, shorten, or modify any lesson due to weather conditions, safety concerns, force majeure (e.g., strong winds, storms, or unsuitable sea conditions), or operational reasons.
- In such cases, we will offer a reschedule at no extra cost (subject to availability) or an alternative activity (e.g., switching from kite to surf or wingfoil).
- No cash refunds will be issued for weather-related cancellations or modifications, consistent with standard policies in Essaouira schools. Refunds are only provided in exceptional cases at our sole discretion.
- We are not liable for any travel, accommodation, or other costs incurred by you due to cancellations.
Changes to Bookings: Any requests to change dates, duration, or type of activity are subject to availability and may incur a fee.
5. Weather Conditions
Essaouira is known for its strong and consistent winds, but conditions can vary. The instructor or school manager makes the final decision on whether conditions are suitable for kitesurfing, wingfoiling, or surfing. Their decision is final and made in the interest of safety. 6. Participant Responsibilities and Health
- You must be in good physical and mental health and able to participate safely. You must inform us in advance of any medical conditions, injuries, allergies, or disabilities.
- Participants under 18 must be accompanied by a parent or guardian who signs all waivers.
- You must arrive on time, wearing appropriate clothing (wetsuit provided where needed). Late arrivals may result in a shortened lesson with no refund.
- You agree not to participate under the influence of alcohol, drugs, or any substance that impairs judgment or safety.
- You must follow all instructions from instructors at all times. Failure to do so may result in immediate termination of the lesson without refund.
7. Safety, Conduct, and Liability Waiver
Water sports involve inherent risks, including (but not limited to) injury, drowning, equipment failure, or environmental hazards. By participating, you acknowledge these risks and agree to the following:
- Waiver of Liability: You release Kite Maroc, its owners, instructors, staff, and affiliates from any and all liability for any injury, loss, damage, or death arising from your participation, to the fullest extent permitted by Moroccan law. This includes claims based on negligence (except gross negligence or willful misconduct).
- You assume full responsibility for your own safety and equipment use.
- A signed liability waiver is required before any activity.
- We are not responsible for loss or damage to your personal belongings.
8. Equipment Rental and Use
- All rented equipment must be used with care. You are financially responsible for any damage or loss caused by misuse or negligence (beyond normal wear and tear).
- Equipment must be returned in the same condition at the end of the session.
- Rental equipment is for use only during supervised lessons or designated rental periods.
9. Intellectual Property and Marketing
Photos, videos, or content taken during your activities may be used by Kite Maroc for promotional purposes (website, social media, etc.) unless you explicitly request otherwise in writing before the activity.
10. Privacy
Your personal data is processed in accordance with applicable Moroccan data protection laws. We do not sell your data to third parties.
11. Force Majeure
We are not liable for any failure to provide services due to events beyond our reasonable control (e.g., extreme weather, natural disasters, strikes, pandemics, or government restrictions).
12. Governing Law and Dispute Resolution
These Terms and Conditions are governed by the laws of the Kingdom of Morocco. Any disputes shall be subject to the exclusive jurisdiction of the courts of Essaouira, Morocco.
13. Changes to Terms
Kite Maroc reserves the right to update these Terms and Conditions at any time. The version in effect at the time of your booking will apply. Continued use of our services constitutes acceptance of any updates.
